ZA Bikers Dealer Network Terms and Conditions

These Terms and Conditions govern the use and purchase of ZA Bikers’ online products and services, including membership of the ZA Bikers Dealer Network.

2. The ZA Bikers Dealer Network

The ZA Bikers Dealer Network is an online marketing and directory service connecting motorcycle dealerships with South African motorcycle enthusiasts.

Available services may include:

  • A dealership profile on ZA Bikers
  • Motorcycle inventory displayed through an AutoTrader feed or manual listings
  • Trade News publication
  • Sell Your Bike lead opportunities
  • ZA Bikers original editorial content
  • Professional photography
  • Other promotional or reporting services displayed as part of the selected package

The exact features, price and billing period applicable to an order will be displayed on the package or checkout page before payment.

3. Prices and VAT

Dealer Network prices are quoted in South African rand.

Prices may be advertised excluding VAT where clearly indicated. The total amount payable, including VAT and any applicable charges, will be shown before the customer confirms payment.

ZA Bikers may change its package prices from time to time. A price change will not affect a period that has already been paid for. Customers will be informed of any change affecting a future renewal before the new price is charged.

4. Payment

Online payments are processed securely by PayFast by Network.

ZA Bikers does not receive or store customers’ complete card details. Payment information is processed by the payment provider in accordance with its own security and privacy requirements.

Customers must provide accurate billing and account information and must be authorised to use the selected payment method.

An order is only confirmed once payment has been successfully processed.

5. Recurring billing and automatic renewal

Paid Dealer Network packages are available on monthly, three-month, six-month or twelve-month billing terms, as displayed at checkout.

By purchasing a recurring package, the customer authorises ZA Bikers and its payment provider to charge the selected payment method automatically at the beginning of each new billing period.

Unless cancelled:

  • Monthly packages renew every month.
  • Three-month packages renew every three months.
  • Six-month packages renew every six months.
  • Twelve-month packages renew every twelve months.

ZA Bikers will send a renewal reminder before the automatic renewal of a three-month, six-month or twelve-month package.

The amount and frequency of recurring payments will be displayed before the customer completes the initial purchase.

6. Activation and delivery

Dealer Network packages are digital services. No physical product is delivered.

ZA Bikers will normally create or activate a paid dealer profile within two business days after:

  1. Successful payment has been received; and
  2. The customer has supplied all information reasonably required to create the profile.

If information is missing or requires clarification, the activation period will begin once the required information has been received.

AutoTrader feed activation may take longer because it depends on receiving and configuring the necessary feed information. ZA Bikers will communicate the expected activation time to the dealer.

Editorial features and professional photography are scheduled separately according to availability and the ZA Bikers editorial calendar.

7. Customer approval and profile review

Payment does not require ZA Bikers to publish unlawful, misleading, inappropriate or unsuitable content.

ZA Bikers may review a dealer profile before publication and may request corrections or additional information.

If ZA Bikers declines an application before providing any paid service, the customer will receive a full refund.

8. Cancellation

A customer may cancel a recurring Dealer Network package by emailing [email protected] before the next scheduled renewal date.

Cancellation will:

  • Stop future recurring payments
  • Take effect at the end of the period already paid for
  • Allow the customer to continue receiving the paid package benefits until that date

Cancellation does not ordinarily create a refund for the remaining portion of a billing period that has already started.

At the end of the paid period, ZA Bikers may:

  • Revert the dealer to a free profile, where applicable
  • Remove or unpublish motorcycle inventory
  • End Trade News, editorial and photography benefits
  • Remove the dealer from Sell Your Bike lead distribution
  • Disable other paid-package features

Where the Consumer Protection Act or another applicable law grants the customer additional cancellation rights, the cancellation will be handled in accordance with that law. A reasonable cancellation charge may apply where permitted by law and where services have already been performed or costs incurred.

9. Cooling-off rights

Where section 44 of the Electronic Communications and Transactions Act applies, a qualifying consumer may cancel an electronic transaction for services within seven days after concluding the agreement, without reason or penalty.

Where the customer expressly requests that ZA Bikers begin providing the service before the end of that period, the service may commence immediately and the statutory cooling-off right may no longer apply to the extent permitted by law.

Nothing in these Terms and Conditions limits any rights that cannot legally be excluded.

10. Refund policy

Refund requests must be sent to [email protected] and must include the dealer’s name, payment date and reason for the request.

A full or appropriate refund will be provided where:

  • A duplicate or incorrect payment was processed
  • ZA Bikers declines the application before providing the paid service
  • ZA Bikers cannot provide the purchased service
  • A refund is required under applicable South African law

A renewal payment may be refunded if the request is received within seven calendar days after renewal and no paid benefit for the new billing period has been used or delivered.

Except where required by law, refunds will not ordinarily be provided:

  • For a change of mind after the service has commenced
  • For an unused portion of a billing period
  • Where the customer has failed to provide the information required to deliver the service
  • Where a profile or content has been suspended because the customer breached these Terms
  • For editorial, photography, feed-configuration or other work that has already been completed or commissioned

Approved refunds will be returned through the original payment method where reasonably possible. Processing times may depend on PayFast and the customer’s bank.

11. Failed payments

If a recurring payment fails, ZA Bikers or its payment provider may notify the customer and attempt to process the payment again.

If payment remains outstanding, ZA Bikers may suspend the paid services or revert the dealer to a free profile until the account is brought up to date.

The customer remains responsible for any amount properly due for services already supplied.

12. Dealer information and motorcycle listings

Dealers are responsible for ensuring that all information supplied to ZA Bikers is accurate, current and lawful.

This includes:

  • Contact and business information
  • Motorcycle descriptions, prices and availability
  • Images, logos and promotional material
  • AutoTrader or other inventory-feed information
  • Specials, events and Trade News submissions

Dealers must have the necessary rights and permissions to provide and publish all submitted content.

ZA Bikers may correct, remove or suspend inaccurate, outdated, unlawful or misleading content.

13. Trade News and editorial content

Trade News, original editorial features and other published content remain subject to ZA Bikers’ editorial standards, approval and scheduling.

The inclusion of Trade News in a package does not guarantee that every submission will be published. Submissions must be relevant, accurate and suitable for the ZA Bikers audience.

Where a package includes a monthly original editorial feature, it must be scheduled by agreement with ZA Bikers. Unused monthly editorial benefits do not automatically accumulate or carry over unless agreed in writing.

ZA Bikers retains final editorial control over headlines, wording, images, publication dates and presentation.

14. Intellectual property

Customers retain ownership of their existing logos, photographs and marketing material supplied to ZA Bikers.

By submitting content, the customer grants ZA Bikers a non-exclusive licence to edit, reproduce, publish and promote that content for the purpose of delivering the selected services.

Unless otherwise agreed in writing, ZA Bikers retains copyright in original editorial content and photography created by ZA Bikers or its contributors.

The dealer may share links to published articles and use approved supplied media for its own marketing, subject to appropriate ZA Bikers credit where requested.

15. Leads, exposure and results

ZA Bikers provides marketing exposure and opportunities to connect with prospective customers.

ZA Bikers does not guarantee:

  • A specific number of profile or motorcycle views
  • A particular number of enquiries or leads
  • That an enquiry will result in a sale
  • A specific search-engine position
  • Any particular commercial outcome

Sell Your Bike leads depend on enquiries received from members of the public and may vary from month to month.

16. Service availability

ZA Bikers will take reasonable steps to keep the website and Dealer Network operational.

Temporary interruptions may occur because of maintenance, hosting problems, third-party services, security requirements or circumstances outside ZA Bikers’ reasonable control.

ZA Bikers may improve, replace or discontinue individual features, provided that the overall substance of a paid package is not materially reduced during a period already paid for without an appropriate alternative or remedy.

17. Suspension or termination

ZA Bikers may suspend or terminate a dealer profile where the customer:

  • Fails to make payment
  • Supplies false, misleading or unlawful information
  • Infringes intellectual-property rights
  • Misuses the platform
  • Publishes or supplies harmful, discriminatory or inappropriate content
  • Acts in a way that may reasonably harm ZA Bikers, its audience or other businesses
  • Materially breaches these Terms and fails to remedy the breach after receiving reasonable notice

Where reasonably possible, ZA Bikers will give the customer an opportunity to correct the issue before terminating the service.

18. Privacy

ZA Bikers processes personal and business information in accordance with the Protection of Personal Information Act and the ZA Bikers Privacy Policy.

Information may be processed for purposes including:

  • Creating and managing dealer profiles
  • Processing payments and subscriptions
  • Communicating with customers
  • Delivering purchased services
  • Maintaining records
  • Preventing fraud and misuse
  • Complying with legal obligations

Payment information is also processed by PayFast in accordance with its own privacy and security policies.

19. Transaction records and invoices

Customers will receive an electronic payment or order confirmation.

Invoices and relevant transaction records will be supplied electronically or made available through the applicable customer account where that functionality is available.

Customers should retain copies of their confirmations, invoices and these Terms and Conditions.

20. Limitation of liability

To the extent permitted by law, ZA Bikers will not be liable for indirect or consequential losses arising from:

  • A dealer’s inaccurate or outdated information
  • The acts or omissions of a dealer or prospective customer
  • Third-party platforms, feeds or payment services
  • Temporary website interruptions
  • A failure to generate expected leads, enquiries or sales

ZA Bikers’ liability for a direct claim relating to a paid service will not exceed the amount paid for the affected service period, except where liability cannot legally be limited.

21. Changes to these Terms

ZA Bikers may amend these Terms and Conditions when its services, payment arrangements or legal obligations change.

The version applicable to a purchase will be the version available when the transaction is concluded. Material changes affecting an existing recurring subscription will be communicated before the customer’s next renewal.

22. Governing law and disputes

These Terms and Conditions are governed by the laws of the Republic of South Africa.

ZA Bikers will attempt to resolve the matter reasonably and in good faith.

23. Acceptance

By placing an order, selecting a recurring package or requesting activation of a paid Dealer Network service, the customer confirms that they have read and accepted these Terms and Conditions and the ZA Bikers Privacy Policy.
